In the context of the applications for most categories of work permits a benchmarking of the terms and conditions of the foreigner’s prospective employment and specifically of the salary is required. The authorities wish to establish that the terms and conditions of employment are not inferior to those of a South African in a similar position. This is intended to prevent the import of cheap labour potentially harming the local labour market.
The benchmarking may be issued by the responsible office of the Department of Labour, whereby not all offices are prepared to do this. Alternatively, the benchmarking may be issued by a professional firm, which is generally a quick and effective process, however incurring additional costs.
IMCOSA liaises with the Department of Labour or the private firm to obtain the relevant salary benchmarking.
